PTO Rule Change IRC Application

As you would be aware, APA (NSW) made an application to the Industrial Relations Commission (IRC) to change our rules to allow us to continue to represent Patient Transport Officers (PTOs) whose employment was transferred to HealthShare NSW. Our case was heard back in early June 2016 however we are yet to receive an outcome from the IRC who reserved their decision at the end of the hearing.
A number of PTOs have contacted us concerned about the upcoming IRC matter on 9 and 10 November with respect to PTO working conditions. Prior to transition, APA (NSW) was heavily involved in discussions with HealthShare NSW regarding working conditions (including at the level of the IRC). At the time of transition, there were a number of outstanding matters. Post transition, despite attempting to do so, the IRC has refused to allow us to be a party to the ongoing discussions. APA (NSW) notes that we have also assisted individual PTOs who are not members of the other union to attempt to become a party to the IRC proceedings however the IRC determined this would not be possible.
To address concerns of PTOs, on Friday 21 October 2016, we sent a letter to the IRC requesting that the PTO rule change matter be relisted so that we can obtain an interim order to continue to represent our members in the upcoming hearing of 9 and 10 November whilst awaiting the final decision of the IRC. However to date we have not heard back from the IRC with respect to our request.
We want to assure our PTO members that we are doing everything within our power to try to represent your best interests.
We are hopeful that the IRC will list the matter early next week or provide us with a final decision.
